I hear what you're saying, and I'm all about using DPF when you are Justified, but I would be concerned for the gun shop guy if he were to use DPF before the guy charged a round, in New York state. Although once a guy charged around I would think it would be easily justifiable. But again I'm no expert, just an average citizen who has stayed at the Holiday Inn.Interesting. I gotta wonder what exactly was going through the employees mind while this was going on.
I would be curious to know the reason he did not shoot the guy dead right then and there. The articulation of self defense would be rather easy.

Buffalo Gun Center just the other day I could have done this with a pistol no problem. One guy handed me and another one a gun. I turned around to look at the gun since I didn’t want to point it at the guy next to me or the dude behind the counter. I probably could have walked right out of the store with it. They really weren’t paying attention. I set it on the counter when I was done looking at it and it took him about 5 minutes to put it away. I told him a few times it was a nice gun and I’d be back for it after making some side cash. Never said a word or even looked at me.In every gun shop I've ever visited, it is 1 customer at a time being served and watched by 1 clerk or owner. I'm pretty sure that if this happened in any of those shops, that the clerk would have near instantly drawn on the guy the instant he pulled out a mag or ammunition and attempted to load it and chamber a round. And if he didn't stop right then, he would get shot.
I suspect that some pawn shops do not have quite the same regimen in place as they sell a bunch of different items including guns.
I remember an incident a couple of years ago at a downtown Buffalo pawn shop when a guy came in, asked to handle a shotgun, and before the clerk reacted, they guy loaded a live round into the shotgun.
He was suicidal, put the gun under his chin, and blew his brains all over the sales room items and the ceiling. It took them several days to clean up everything and get the blood and tissue splatter off of the used toasters, etc.
