He should have drew and shot him while their was no round in the chamber and the gun was pointed all the way to the right. The guy was right in front of him he couldn’t have missed. I’m guessing this guy was rather untrained and slow moving. He drew his gun really slow.

I would be curious to know the reason he did not shoot the guy dead right then and there. The articulation of self defense would be rather easy.

I hear what you're saying, and I'm all about using DPF when you are Justified, but I would be concerned for the gun shop guy if he were to use DPF before the guy charged a round, in New York state. Although once a guy charged around I would think it would be easily justifiable. But again I'm no expert, just an average citizen who has stayed at the Holiday Inn.

Tough call, is the employee in fear for his life?
The bad guy is there for trouble.
If the employee turns and runs, the crazy guy could easily charge and fire before the employee could get away.
The crazy didnt ask to see an unloaded mag to test the mag insertion and release, he took out his own loaded magazine.
Is he there to just steal a gun? Is he there to steal a gun to use in a crime elsewhere? Is he there to kill the employee?
Again, tough call but the employee MUST go home safe.

Really quite surprised this doesn't happen more often. After the gun store scene in the Terminator, a lot of people had their eyes opened to the possibilities of it working in mom and pop shops.

Pull the bolt or BCG on a long gun, tag it and keep it locked up in the back. Customer gets it when the sale is completed.

I'd always thought this might some day be a scenario that might go down in a gun store. I'd never purchase a firearm unless I could check it out first, but I've made a habit of telling the sales rep of exactly what I'm doing.
I could see a theft-robbery of this type becoming more common in the future. Sooner or later it might not end well. Store owners are going to have to learn from this and mentally prepare themselves to administer tough love as necessary.

In every gun shop I've ever visited, it is 1 customer at a time being served and watched by 1 clerk or owner. I'm pretty sure that if this happened in any of those shops, that the clerk would have near instantly drawn on the guy the instant he pulled out a mag or ammunition and attempted to load it and chamber a round. And if he didn't stop right then, he would get shot.
I suspect that some pawn shops do not have quite the same regimen in place as they sell a bunch of different items including guns.
I remember an incident a couple of years ago at a downtown Buffalo pawn shop when a guy came in, asked to handle a shotgun, and before the clerk reacted, they guy loaded a live round into the shotgun.
He was suicidal, put the gun under his chin, and blew his brains all over the sales room items and the ceiling. It took them several days to clean up everything and get the blood and tissue splatter off of the used toasters, etc.

Buffalo Gun Center just the other day I could have done this with a pistol no problem. One guy handed me and another one a gun. I turned around to look at the gun since I didn’t want to point it at the guy next to me or the dude behind the counter. I probably could have walked right out of the store with it. They really weren’t paying attention. I set it on the counter when I was done looking at it and it took him about 5 minutes to put it away. I told him a few times it was a nice gun and I’d be back for it after making some side cash. Never said a word or even looked at me.
