Ammo background checks to begin mid-September?

If you have a 9, 38, 380, 40, or whatever on your permit, the state (and fed) knows what's on your permit, so what's the point, the reason for going thru a BG check to buy ammo for one or all of your pistols. It's harassment, intentional, plain & simple, put upon us by NYS. And CHochul and her ilk call Donald Trump Hitler and say if he's elected it's the end of Democracy... do tell, bitch.

There's no reason to buy ammo in NYS if you have transportation to get to a free/er state, and have the time to make the trip. That, and there's principle to consider.

So what’s the legal definition of engaged in the business of. There’s a discussion on another firearms board going on saying since it says commercial sale and engaged in the business of selling ammo you need to be a business selling ammo and we could still sell it to each other.
The legal definition of a commercial sale is just about any sale that takes place but engaged in the business of isn’t so clear and many definitions exist. I looked at penal law 265 subsection 24 and it simply says engaged in the business of. This could be taken as anyone selling it is engaged in the business of or you need to be an actual business selling it.

Look at eBay. Used to be able to buy/sell/auction to one another and not have to pay tax. Just one giant yard sale. Only thing you had to pay was eBay seller fees and shipping (unless local pickup).

Used to use ebay all the time because of that.

I don't get how a person buying a used Gibson guitar from a private (non-business) seller should be charged tax, when I could just go to them directly, and do a Venmo or Paypal, or good old cash and buy it without paying sales tax.

I sold some wheels with tires on eBay last year, and I charged $1,200 local pickup only on eBay. The seller bought them and forgot about taxes which drove up the price to a little over $100 extra. I told them I'll refund them and they can pay cash when they arrive. That is exactly what I did and it worked great. Not only did I save sellers fees, but I also saved the buyer sales tax. Fuck this state and fuck eBay.

Well here is an update I just ran into. I’m in Kentucky and went to Bud’s Guns. Ammo I wanted was behind the counter. I had my hands on 4 boxes until I mentioned I was from NY. They took them away. It’s their company policy not to sell to states that have background checks.
So once again my mouth bit me in the ass again.
Good thing there is another Bud’s in Tennessee I’ll be driving past.

My lesson here to everyone is keep your mouth shut and don’t make small talk

That REALLY sucks. We have background checks to buy firearms and Bud's has no problem shipping guns to NY but they won't sell ammo to someone who unfortunately lives in this shit hole??!

That really does suck. Other out of NY state gun stores seem to have no problem selling ammo on site to NY'rs. Makes me wonder, how did NYS, Hochul get to Bud's?? And too, if Bud's won't sell ammo on site to a NY'er, why do they sell guns to NYers? Makes no sense to me.

I bought a pistol from Bud's several months ago and no problem... shipped to my FFL and that was that. What sucks more, Bud's has a pretty good deal going on a 9MM S&W I've been eyeballing. But, out of principle, now I don't know if I want to deal with them.

I don’t think the state’s original intent was to force people to buy ammo out of state as much as it was to put the screws to us and slow down the free flow of ammo.
We are being hit with a two dollar and fifty cent charge for every check, that in itself is an insult.
l can’t blame anyone who chooses not to play whorecul’s deceitful game and go out of state to buy their ammo even if it hurts the retailer at home ( ammo isn’t their sole business and we still have to buy our firearms here).
I can’t blame anyone who refuses to stay and fight the tyranny and moves to free America either.
I’ve lived in many places, here and abroad and this is the worst as far as freedom and liberty. I may be a fool but I hold out hope that the bill of rights will prevail and put an end to this bullshit.

Bud’s have been playing stupid games with NY’ers for years. Fuck them . I deleted Bud’s from my book marked firearm sights a few years ago.
