shit i put the 340cc ski doo motor on the kitchen table and tore it down and rebuilt it .. come on .. LOL . ( i really did that ) ..

I agree shit happens. Just glad it was too and not me. I landscape on the side for my gun money and I had my kimber in a soft sided holster and I walked down the stairs fast. Gun flew out of the holster and skidded along the concrete basement floor. I was like shit. Picked it up and a few small scratches was all. I was surprised. I took super fine steel wool and you can barely see the scratches.
I know others who have scratches and damaged guns and was honest with the manufacturer and they were all repaired for free. Basically my FIL fucks with many things he shouldn’t so it was him damaging his guns a few times.

To the OP, like others have said. Perfect example of "it can always be worse". Saltwater could've found out that his Kimber wasn't drop safe.

The package is supposed to arrive this Friday so I’ll be waiting. I’m curious what was wrong but screw it I'm gonna shoot a bunch of rounds through it this weekend.

First off what I said was just an embelishment of Rugers customer service. I don't really expect them to send a replacment rifle if the reciever half is undamaged.
Secondly, what do you make of that excerpt from the ATF? Am I reading that wrong or does that state a replacement rifle can be sent to the owner?

478.147 Return of firearm.

My guess, would be that if a manufacturer decides to replace a rifle for a customer who sent their original in for repair, that the manufacturer has to deal with the paperwork for keeping the original rifle and sending a replacement with new serial number to the customer. So it probably gets recorded that way. Why would one have to go through yet another nics because you sent a gun in for repair and the manufacturer decided to send you a replacement? I would assume manufacturers have some kind of FFL licensing.

Well, that may be, in which case he would likely only be receiving a new barrel assembly like you suggest, but the overall argument about weather a manufacturer could send you a replacement gun is spelled out in the ATF's own rules and I think I have done a fair enough job of pointing that out.

As others have said if the rifle coming back has a different serial # than the one you sent in it will have to go through an FFL and you will have to do a 4473 on it. I had the same situation when I sent my AR15 back to Daniel Defense for service. They just replaced the whole rifle and I had to do a new 4473 to take possession of it.
If the gun coming back has the same serial # as what you sent you should be able to have it shipped back to your home directly I think.

Yes, you are correct, that was never your argument. Sorry @Willjr75. I just got jumped on for asserting that a manufacturer could indeed send you a replacement gun without the end user having to go through another 4473 even though its in black and white via ATF publications. The posting of mine which started all this, was really just an exaggeration of what Ruger might do considering their customer service rep. (which is great). Certain members took it like I was certain Ruger would send a complete replacement rifle.

Are you for real? did you not read what I posted directly from the ATF's website? Certain manufacturers may choose to go through an ffl for their own reasons, but that is not what the law says. I'm fucking done with this conversation. READ THE GOD DAMNED ATF RULES!!!! Or don't but fuck off!!

The last section is a little vague to me.
It says replacement firearm which implies a new serial # but doesn't specifically state that a new rifle with a new serial is yet exempt from a new 4473. How would the dealer account for the firearm in question? Do they have to enter it into their books at any point in this process?
Firearms law is highly inconsistent and frequently contradictory so there is no point in getting so worked up over confusion regarding the subject. In any case regardless of what the letter of the law actually is I very highly doubt an FFL will allow the end user to take possession of a firearm with a serial number for which a 4473 has not been done previously until said form has been done.
