Again. Just cause they dont let you has nothing to do with the law.

My employee checked with the DA about this exact issue. The law does not forbid this.

The rifle is being shipped directly to my home. So more than likely Ruger replaced some parts or one of the assemblies. I highly doubt they would replace the entire rifle and if so I will contact my FFL to make sure I’m playing by the rules.

This seems pretty simple, I don't know why you guys are making it so complicated.

If you ship it directly to the manufacturer, they can ship it directly back to you. If you want to print out a 4473, fill it out, frame, and hang it on your wall, you can, but you do not have to. You cannot do a NICS check because you are not an FFL.

If you have an FFL ship the gun for you for whatever reason (personal preference, ignorant employees at the local UPS store, whatever) then the manufacturer will ship the gun back to the FFL, and the FFL will put it in his books and do the whole paperwork dance.

No, this was a simple thread about someone who sent their rifle back to the manufacturer for evaluation and repair but it turned into a thread of butt hurt people not wanting to read the actual regulations pertaining to such matters.

If they are shipping to your home then you don't have to worry about it. I am still curious to know what was wrong with it when you get it.

Your ffl may not know? Many dont know and they pass on/make up bad info.

Well I stand corrected. I just went through this with kimber and a pistol, maybe it was because it was a short gun or because it was the PRNY. Kimber would not ship the replacement to me, it had to go to an FFL.

If you are talking about Kimber sending you a replacement handgun, unless there was something I missed, it is likely one of two things. 1. Kimber just prefers to send it back through an FFL for no good reason. Or 2. (and most likely considering NYS handgun law) a replacement handgun would have to go through an FFL because you need to have your permit amended to have the serial# match on your permit. If you lived in a free state, they could just send you the replacement handgun same as a rifle or shotgun. Unless, Kimber is just stupid and makes all of it's customers, regardless of state, go through another nics and have to pay transfer fees on something they already did so on. In which case to hell with them.

Located In Yonkers is bet Kimber is quite familiar with unSAFE and the requirements of getting it added to license prior to taking possession of it. They would be setting up an owner for a felony if they sent a pistol with a new serial number directly.

That’s it right there. Kimber cannot send you a handgun to your home because the serial number will not match what’s on your license. If they do so, you will be in violation of Penal law 400.

I know their website says Yonkers, NY, but my customer service guy was in Montana, getting away from the High NY payroll tax maybe?

This is clearly what happens when you go around putting people on ignore. You’ve gotten the answer twice already on why your new handgun with a new serial number got sent to a FFL.

Correct. Sent malfunctioning receiver to Keltec and they sent a new one directly back to me. They also enclosed a letter for my records explaining the transaction if I needed it in the future. I no longer own the gun.
