You don’t think millers food has any dead bugs or mouse shit in it? All this comes from how the ingredients harvested. Can you tell me how you would keep big parts out of wheat, corn, or soy beans harvested with a combine or large machine? It’s probably impossible and that’s why it’s allowed.
I’m glad he “won” but I would ask what are the $55,000 on fines for and will he keep incurring them? This isnt the whole story.

If the FDA and USDA inspections worked properly, food wouldn't be recalled after customers got sick from eating spinach or hamburger. Nor would endless recalls occur for blood pressure medications containing carcinogens.

The Mennonite store I visit in the ADK area is supposedly owned or operated under their church. That equals tax free. It has grown from a small family butcher shop into a multi-million-dollar enterprise. The only other business I see growing at that rate are the Indian casinos.

Not true at all. That’s like saying we have laws against murder so it’s the governments fault we have murder.
With hamburger the goal of having a USDA inspector on site is to have a clean, fecal free slaughter. Can an inspector see every bit of fecal matter? As for other recalls like leafy greens the regulations were almost nonexistent for farmers until recently. Also the inspectors can’t be everywhere everyday. Rules and regulations are in place but if the businesses don’t follow them a government official isn’t on site everyday to see it all being done. The exception is USDA slaughters.
I’m not saying I agree with all food regulations but most are there for a reason. What I disagree with is the other regulations like DEC, EPA and others that make it harder, more costly, and more complicated to do business. Yes USDA inspectors do add significant cost so that is an exception.

The problem isn't the government setting standards.
The problem isn't even the government inspecting for compliance with standards.
The problem is the government claiming a monopoly on those standards. Monopolies are bad, almost universally.
So, selling raw milk, or anything else shouldn't be a crime unless you advertise it as FDA Compliant. Then the crime is fraud, and so is the tort.

1. The USDA is specifically targeting Miller’s Organic meat processing operation, not his entire farm. Amos Miller processes and distributes beef, poultry, and pork which he processes in one of his self-made processing facilities. Animals are processed under the inspection and oversight of Amos Miller and not the USDA. According to USDA regulations, meat must be processed under the direct oversight of a USDA agent if it is going to be distributed direct to consumer. This regulation give the USDA direct control of the farm to consumer meat supply. However, setting the element of control aside, processing at a USDA facility poses problems for Miller’s customers. USDA processing facilities spray meat carcasses with citric acid, a chemical compound that produces allergic reactions in some of Miller’s customers. 2. MIller’s operation is healing not harming the public. 3. Miller is not being allowed to choose his own attorney. Federal Judge Edward G. Smith ruled that in the USDA vs. Amos Miller case “Amos Miller does not have the right to choose his own attorney”. Miller is taking his appeal to Third Circuit in Philadelphia. Miller states: “we have come to realize that the only way to save our hard working farmers and healthy foods is to legally challenge the government”.

They aren’t there 24/7. Maybe on his place because of this case/issue. Yes some places like the big ones might have them there more often(maybe even 24/7) but they are required to be present during certain activities. One I know for sure is when certain animals like cattle and pigs are being slaughtered. Also if you slaughter a certain amount of poultry they are required to be present as well. The smaller butchers they are only there maybe a day or two per week that slaughter. Some butchers may never need one on site for slaughtering activities.

A meat inspector is on site when an animal is killed . A small mom and pop place will kill perhaps once a week . Then an inspector will look at the carcass for a disease or damaged meat. say for liver flukes. The liver would be discarded ... not the whole animal
If it passes then a USDA stamp is rolled on the carcass approving it. If a plant is running 24/7 then yes then a slaughter plant would have an inspector on site at all times.

When I was raising my family and paying off my student loans, we bought meat from an institutional meat processor. Walk in on the right was where the, old, cows, got the shaft. Keep walking and you end up where the coolers and processing happened and ordered your meat. Standing next to the ~8 butchers cutting away.
Went there many times even saw a bull running around the parking lot, never saw an inspector; but the meat hanging all had stamps.
Never saw an inspector in the barn when we processed deer .

The usda and ny state do not want small processors. Friends of ours opened a small, fully by the book butcher shop on their farm. They process our animals as well. All following the rules the gubment has put into place and they are still harassed. Borderline bullied at times but luckily the owner doesn’t take their shit and won’t back down. He’s had some very colorful conversations with gov agents.

As I said earlier in this thread at first it was said it was for religious purposes and now it’s said he doesn’t want to do it for allergens? I have never heard of anyone being allergic to beef or any other meats.
I don’t disagree with this man on principle and if he has signs stating his products or beef are not USDA inspected or certified than he should be able to get around paying for an inspector, but I find his reasons for not wanting to abide by the rules to be an outright lie. I can tell you what it’s all about and it’s that he doesn’t want to pay the fee to have an inspector on site. I’m one with that but then you have to put up signs saying not USDA inspected or certified. The issue is the USDA doesn’t allow for that. He should be upfront about his true intent.
A 99cimmins indictated it is burdensome and it is causing a lack of small butchers in NYS and the rest of the USA. Do I think he should have to be usda certified no, but at least be honest about the reasons and he appears not to be IMO. The cost is prohibitive in many cases especially for small slaughter houses.
The rules are stupid and if you kill 2,000 chickens you don’t need to be USDA but if you kill 2001 you do.
