Missouri Couple Defends Their Home From Rampaging Mob Who Broke Through Perimeter Gate on Private Property…

These people were totally within their rights to be out there protecting their house. The spin that these were protestors acting peacefully is pure bullshit. The entire community is private, gated and locked. These people were not on a public street or sidewalk. They had already forced entry and broken in, literally.
We can debate if it was the right tactic to stand outside vs. stay inside all day. It's a hard call if you weren't there. You need to make sure your home, which you have millions invested in is protected, but you also need to make sure you don't end up in prison. If I were out there I wouldn't have pointed my gun at anyone. I think they were far enough away where it was unnecessary. Unless you're ready to take a shot, keep the muzzle pointed down.
All of that being said, I think the guy did a pretty good job handling himself. There are a few things he could improve on but overall he did fine. His wife on the other hand, wow. From her finger jammed into the trigger guard, to pointing the muzzle at the crowd, to the way she haphazardly held the pistol with one hand... She needs to take some training. They can afford it.

The individuals who trespassed and criminally destroyed property were the agressors and escalators. Once they did not leave the property, they escalated it more. Add to it shouting at the homeowners additional salt!... Homeowners would only be escalating if they left their property to confront a mob in the street in front of their home, and that's even debatable if they were carrying Molotov Cocktails for example! Hahaha

Also, even here in NY you can use physical force (but not deadly force) to remove trespassers. If they escalate such that your in danger of serious bodily harm, then deadly force would be warranted.

To be honest, im watching on my phone, I didnt even see she had a gun at first. Either way, the mob threatened to kill them and their dog. She WAS in fear for her life.

This is a unique situation. Most people are treating it as if the people were out on the sidewalk in front of the house. In reality this is a gated community and they had already broken in. Imagine if your back yard was fenced in and 500 people knocked down the fence and were in your back yard shouting and threatening you.
This is why they were justified in their actions, where if someone out in front of an average house had a gun pointed at them the person would be facing charges.

You are legally allowed to initiate physical force to remove trespassers. You are the initial aggressor, but just like a cop effecting an arrest you are entitled to.
You do not bring a lethal weapon, so it can't be taken from you.
I clearly stated that this requires that you have armed backup. So, you might get your ass kicked. But if you do, then your backup clearly has justification for the use of deadly force.
Except A35 states even in the home you may not be the initial aggressor.

Right, you can't hit them *before* they are trespassing.
If you can't initiate physical force afterwards, then none of section 2 has any meaning.
You running up to them and initiating and escalating (being the aggressor) is not going to fly as an exemption for using deadly force. Even if you think you found some loophole, the court of public opinion (and jurors) are going to indite and convict you.
Besides, once you're surrounded by the mob is the wife just going to start shooting into the crowd? This strategy is DOA.

Ok, you're clearly misreading A35.
The limitation on being the initial aggressor is in 35.15 and only applies there.
The justification to stop trespassers is in 35.20 and not subject to that limitation at all.
Unless you think cops affecting an arrest are also not allowed to be the initial aggressor.
The sections pertaining to cops are clearly labeled so. Section 35.30 discusses police making arrests.

Now your outcome in the inevitable Civil suit might not be so good, but criminal charges would not be forthcoming.
The DA's want nothing to do with this stuff. They will surely go to grand jury so the decision to charge is not theirs. The public will indite and convict for sure. It would look extremely bad.

Think of it this way, George Zimmerman was acquitted.
Now imagine that case took place in his own front yard instead of a public sidewalk, and he wasn't the one who fired, but it was his wife who came out and saw him being beaten to death.
If you had some overzealous DA who did decide to charge, the defense would show pictures of your body face and hear testimony from your wife that she thought you were going to die, and she was going to be next.
