According to SAFE Act code, a pistol in NY is considered an assault weapon if, among other things, the pistol has a threaded barrel capable of accepting a muzzle break (brake?), flash suppressor, compensator, silencer, etc... Many of you know this already.
I'd like to simply bring up two points relating to this.
Firstly, the list on the (un)SAFE act website that lists pistols that are not considered assault weapons is NOT correct. I noticed this after seeing that both the HK USP Tactical and the HK Mark 23 were on that list. Both of those pistols come straight from the factory with threaded barrels that can accept suppressors. I called the (un)SAFE Act hotline and discussed this with one of the reps. I pointed this out to him and he confirmed that the HK USP Tactical was considered an assault weapon and he said that the list was not up to date. I also believe I heard him say that they didn't have any plans to update the list either. I wanted to point this out to prospective pistol buyers so that they aren't duped into buying something they can't leave the store with, or end up with a gun they could go to jail for.
Secondly, I then asked the gentlemen on the phone if I could theoretically have a custom barrel made which did not feature threading but had a muzzle device permanently affixed by different means, or that had the device manufactured as an integral part of the barrel. He said this was acceptable (NOTE: I still think a suppressor would be illegal even if you manufactured it into the barrel).
