I skimmed through the whole decision and to me it seems like while they are clear that "shall issue" licensing for concealed carry is allowed (as in 43 other states) the current NYS scheme of licensing to even purchase a handgun is unconstitutional and should be null and void. You should be allowed to purchase a handgun to keep in your home and to take locked to a range just as you can currently do with a rifle and shotgun. Anyone else reading this the same way?

If I'm not mistaken, the part of the ruling that does away with the tiered scrutiny review versus text history and tradition now opens the door for all previous court cases that were ruled on using the two-tiered system. Things like the Safe Act where they used intermediate scrutiny to uphold that unconstitutional law could now be challenged. There's no way the Safe Act could hold up under the text history and tradition form of review.

But I am not a lawyer so I'm not 100% sure.

In Pennsyltucky we can have anything and everything under the sun. We can buy and sell pistols and long guns and even make our own all day long. The problem is the tax stamp with NFA items but even that can be overcome. I have silencers. I have SBRs. But that's only because the entry fee is only $200 dollars and you can manufacture them yourself. I hate it with a passion but it's doable. That only leaves full auto. Again you can have them but the cost to buy one that is transferable is astronomical and you can't produce your own. That on top of the $200 stamp.

The common use argument is ridiculous and make me want to puke. That's like saying Lamborghinis aren't in common use so you can't buy them. And car ownership isn't even a right! And as others have mentioned above silencers are absolutely in common use at this point! Anything you can manufacturer yourself legally will sure as hell be in common use. Anyway, just waiting for the full auto jig market to take off.

Common Use does not mean "there are lots of these ARMS being used (i.e., commonly used), so they are ok for people to Keep and Bear."

Common Use should be thought of more as a rubric that reads something like, "Tested technology." This is where you see talk in Heller about "dangerous weapons" being limited or constrained in some or all cases being consistent with the Second Amendment. Dangerous weapons should be thought of as untested/untried technologies (i.e. we don't know if they will blow up in our hand and maybe kill or injure others), or technologies that have been tested/tried and proven to not be reliable and safe for operation (i.e., after rigorous testing and use, this specific technology has been found to fail repeatedly and cause harm and property damage, requiring further testing and remedy before its no longer considered a "dangerous weapon.")

Under this rubric (i.e., the proven technology that doesn't blow up in our face because its defective), most of the stuff a militia would need to defend their nation would be 100% covered by Keep and Bear.

THAT would be the exact opposite of what the decision states. The decision affirms the RIGHT to carry a firearm outside the home. NYC wants to say, "Sure, you have the right to carry outside your home...just not outside your home anywhere in NYC."

What this ruling does is raise the number of potential litigants from maybe a hundred thousand, to potentially nineteen million.

And those nineteen million will have cause to seek Federal relief from courts outside the shrinking pond that is NY.

Nineteen million potential litigants is a big tasty bucket of chum being dumped in the water to attorney sharks that have no qualms about feeding on their own.


NY is also a common law state. They are terrified of precedent. They have threaded the needle for decades, and boldly increased the size of the thread in recent years.

But the eye of the needle has been ever so slowly reducing in size, and has just now been radically reduced.

Of course nothing will happen overnight, that is how the system works. But make no mistake, this has changed the game for them.

And they are VERY unhappy.
