And if they can't find the damn handgun, how can the judge make the determination it's "operable"???? Maybe it was a Glock and got run over by a bulldozer clearing trails? Is it operable if it never gets found? The guy follows the letter of the law, and gets screwed by some snotty high and mighty judge regardless...

he should be able to win that argument: administrative restrictions are not provided for in the law.

Reading the article, as well as from my own experience, I will say that I fear that unless and until "may issue" is done away with in NY and elsewhere, that we are all at risk.
I don't know when that judge is up for reelection, but If I were in that county, I'd be doing absolutely everything I could to see that he got voted out.

Surprise, surprise... he's a Democrat who won in a 2014 recount by 223 votes of 42,000 cast against a Republican. So, I'd say gun owners in Schenectady County are basically fucked until at least 2024...He's 38 years old, and earns $152K/year.
Probably time to call U-Haul, and haul ass out of New Yorkistan.

I agree with you wholeheartedly. But the Second Circuit has said that they are reasonable and can be levied. And when presented with an opportunity to take the case, SCOTUS passed it up.

/beginning of rant. IMHO:
Anybody can Monday morning quarterback Murtaugh's decision to put the gear bag on the roof of his vehicle, but how many of us have put gear up on a vehicle roof and fastened it to a roof rack, - especially when going to an outdoor activity? I know I have. I wonder if this judge would suspend or revoke someone's permit if they lost their permit card because their wallet fell out of their pants pocket?
If Murtaugh's lawyers are correct that the trail was going hiking on, - that it is allowable to both hunt and go target shooting there, - well then, I don't hesitate to say it, but the judge is IMHO, a full blown cock sucking lowlife, unfit to serve as even a dog catcher. Saying that Murtaugh's permit only allows hunting and target practice, and the man said he was going hiking there,- where he was perfectly legal in doing both... So, instead of telling the judge that he was specifically going there to target practice, rather than him saying he was hiking there with his firearm exactly as the permit called for ='s Revocation? Well, that just proves what a mean spirited, grammar Nazi type lowlife who lacks common sense or decency this judge is. Hell, why not take away someone's permit if they take a gun to the range and at the last minute decide to not shoot it? That would make about as much sense as this decision. CCW holders who get him probably need to be extremely precise in their communications with him. I'm guessing the responses will need to be Yes Sir, No Sir, ... and Please Sir, - may I have another?
No asshole with that kind of temperament should ever be a judge. I hope his wife cheats on him, gives him an incurable case of something painful, and then divorces his dumb ass, while taking half of his pension, his kids and the family dog away from him as well. He deserves no less.

That wouldn't happen to Bubba, he would serve 20 years. Traeshawn would be out in a year after his fifth illegal weapon conviction.
What Is amazing is the amount of shootings and illegal guns that are in schenectady, I will not go into Schenectady unarmed because of gang activity and the shooting day and night. The judge is definatley going after the wrong target

It wouldn't be my choice, but was it as bad as the guys in Syracuse who put their guns in the back of the pickup with the tailgate down, and discovered them missing when they stopped for lunch later? That happened a couple of years ago as I recall.
Or is it worse than the people who have inadvertently left a firearm in a bathroom?
...and what about the people who have left firearms in unlocked vehicles and the guns were stolen?

I don't have much compassion for stupidity of the responsibility that goes with the owning a handgun. I agree it's a right infringed on by the Government that makes "permits" necessary, so until rectified, we ,as permit holders, have played their game. So why give the Courts ammunition to pull a permit? It's like leading with your face in a fist fight and getting indignant when knocked out. This guy's stupidity also makes the rest of responsible permit holders look bad. Fuel for the "anti's" to ban ALL guns.

There is no Constitutional Right in NY, as permit holders must jump through the hoops to be "honored" to receive.
IF a banger found that rooftop handgun and did your family harm, at the least, I believe your thinking would change. I treat my handguns as I did my Children: I know where they are, all the time. AND, even if there were no permits, the rooftop owner should be penalized. Just plain @$$ stupid.
