Sick deal on Glock 80%

Hear me out on this. Perhaps @pmcjuryny can respond.

As per the ATF, an 80 percent completed receiver is considered a firearm by their laws and completely legal to own by a non prohibited person. So you are not violating federal laws if you build this.

NY law however defines a firearm as
3. "Firearm" means (a) any pistol or revolver; or (b) a shotgun having
one or more barrels less than eighteen inches in length; or (c) a rifle
having one or more barrels less than sixteen inches in length; or (d)
any weapon made from a shotgun or rifle whether by alteration,
modification, or otherwise if such weapon as altered, modified, or
otherwise has an overall length of less than twenty-six inches;

So what is this? A pistol you might say? If it's a pistol then it's a firearm. Right? Maybe not.

In order to be convicted of Criminal Possession of a Firearm in NY, the firearm must be OPERABLE.

So if you build this and keep it at home unassembled with a slide not attached to it, it isn't an operable firearm by NY standards.

Try it. Get the lower. Make up a name and serial number. Take info to sheriff and add it. No harm no foul.

When youget it added engrave lower. Mill lower. Shoot gun.

That's not what I'm saying. It isn't a firearm until finished as per the ATF. So you finish it then what according to what I wrote and linked? It's a different matter when it pertains to NY.

This is for those that may want to keep an of the books receiver for a rainy day.

Yes that is understood but as soon as you complete the the receiver it is a firearm I would need to have it engraved and then transferred to me then have it added to my license. SUFFOLK county PLB said start out to me they will not add a incomplete firearm to my license and I cook be charge with possession of a unregister handgun.

It's just not worth the time and effort and money to fight this not will I risk my job and Clarence level .

So I'll just have to build a 1911 out of a 100% receiver.

You can build it minus one finishing piece, go to a neighboring free state like PA for example, finish the build, take it to a PA FFL, and have it shipped to a NY FFL just like any regular pistol.

After that, you follow your county's procedures for amending your license.

Whatever Suffolk is telling you is incorrect. It isn't a firearm until it's finished.

What is your opinion on the operable case laws in regards to firearms that aren't put together?

I can't speak for other cops or prosecutors, but putting aside my pro-2nd views, strictly based on MY view of the law, absent other factors (pointed at someone, used in a crime, etc), I wouldn't be interested in a clearly inoperable firearm.

A long time ago I was in a house for something (I can't remember why, I think it was medical) and the resident had a rifle in plain view which was real, but "broken". It was a lever action .30-30 and the side plate was missing, exposing the action which appeared missing parts to me. Other than looking to confirm that, no one gave it a second thought. Remember, this is in the city where technically every firearm must be on either a handgun or rifle/shorgun permit to be legal. That's the only time I have encountered an inoperable firearm that wasn't used in a crime.

I have encountered handguns that were broken, rusted, missing parts, etc which were used to commit robberies and such (most of the time for me they were like that). In that case, obviously things are different.

Where I work now, it is VERY common for clueless people to walk in the stationhouse with guns found when family members pass or when homes are cleared out for renovations. Never once has it ever been an issue. We either voucher them or try to buy them if they are worth it.

It has to be operable according to them for conviction.

Surely they can arrest you. But not convict.

Like I said before if you desire a striker fired project gun the sell 100% frames, you don't have to be locked in to a 1911. Now if you want a 1911 build that's OK too but don't lock yourself into one or the other both are out there.

I finally caved. That's some deal.

I got one of these a couple weeks ago from another vendor... Not as great a deal as that but still less than what others were asking for them..

Be aware that there is a second generation of these 80% lowers that now has a metal insert for the rear rails, instead of having to cut the rails out of the polymer.. Also My rear rails wore very quickly (about 200 rounds) and I was having issues with the pistol firing not only upon the pull of the trigger, but the reset also.. I did a little shimming of the trigger housing and it has corrected the problem for the time being.. I really dont have too much faith in those rear rails lasting in the long term..

Anyone can turn in any firearm, but they only get cash for handguns and "assault weapons".

I just wanted to show that even "illegally" possessing a fully operable firearm doesn't mean automatic arrest or even a slight concern from the cops.

I dealt with an old guy the other day who wanted to disable a Browning semi-auto shotgun he said he had for 50 years so that he could let his permit expire. I begged him to let me buy it so it would still see use. He decided to take it to a gunsmith to "legally" disable it.

Got it yesterday. I like the quality so far. This looks incredibly easy to complete. I'm going to try to get to it next week. Midway has the lower parts on backorder for only $49.00. I may wait though to order upgraded parts from Glockstore. I'm definitely waiting on the slide and such but I'll try it out with someone else's upper.

Serious question. So you get this 80 percent lower and assemble it minus one complete hole that houses a pin. Like the ones that are by the trigger.

Is it a pistol at that point?

It is a firearm according to the feds, but for NY, until you at least have a pistol length slide and barrel to complete it you should be safe. After all you don't need to put a carbine built on a glock frame on a permit for instance...

Not when you complete the receiver, only when you assemble a working pistol on the now 100% receiver does it need to be on a permit....

I have a Advantage Arms kit and they run great when clean and you use the proper Ammo. Currently CMC government supply has them in stock and on sale at 275.00 (not sure if its really a sale or not)

Depending on what you go with for parts, could still be roughly the same as a stock 17. The lure is no paperwork. If that doesn't appeal to you, it's not a good idea.
