Here is what I think they are saying. They are giving the 2nd a warning. If the 2nd drags this out or doesn’t rule in our favor than we can appeal to SCOTUS. I suspect the 2nd will decide by end of the month.

There is a serious reason that the Supreme Court rarely issues interlocutory appeals.

If they (SCOTUS) lifts the stay, then the 2nd Circuit hears the next phase of the case and re-applies the stay, then what just happened?

What has happened is that the 2nd Circuit has effectively over-ruled SCOTUS.

They (SCOTUS) cannot let that happen. They have to be the final legal word.

This appeal to SCOTUS was always a long-shot, and the best that we could have hoped for was to get their attention in the matter. Presumably we did that.

EDIT: an interlocutory appeal is an appeal on one decision within an ongoing case whose full resolution has not yet been arrived at.

I clearly see more than that. The two justices have already taken sides and agree with Judges Suddaby and Sinatra. (and Judge Bumb presumably.)

Any reason everyone didn't jump on board here? The original 6 voters in Bruen? Does this kind of say if it were to go back to them we only have support form these 2 now?

"We understand that NY is trying to bend NYers over and are flagrantly violating their Constitutional Rights, but we must go on with the charade and allow lower courts and the States to flaunt our rulings WE ALREADY MADE IN BRUEN because we are toothless and without the means of enforcing anything...

Hopefully no one gets arrested, Red Flagged, raided, and/or shot while we continue to ponder these weighty matters!"

Glock: It's not time yet. The pieces are not in place for SCOTUS to issue a broad, definitive ruling. At this point , they could only say: 'OK stay lifted.' See below.

Mav: I hope so. I believe the game is headed that way and I would be surprised otherwise.

My opinion: Alito and Thomas realize that this is a shitshow and I cannot imagine they are not lining up for a smackdown. Not only do they have to dump the CCIA, they have to prevent the lefty states from pulling this crap ad infinitum. At this point there is just not enough material to work with coming out of the 2nd Circuit to smack down. They issued a clear warning to the 2nd to not only do their job, but to do it in a timely manner and with respect for Bruen. And that they stand with Suddaby and Sinatra.

You are spot on. I see this is an indirect warning to the circuit courts and see three possible outcomes
1. The 2nd Circuit vacates the stay
2. They keep the stay and we appeal to Alito and Thomas and get the smack down
3. They take too long and we appeal again ti Alito and Thomas for smack down.

The other circuit courts are in check too. I see this all working for good. It will be a little longer but I do think we will be victorious.

And just to think, all these parasites are sucking the life out of all those tax funds we all pay, to delay & deny our rights.

Its not "their money", so they don`t care. Hell they even feed their faces, have lavish party`s, off your tax dollars.

This all just a shit show, and we`re all paying for it. And they will just keep right on doing it.

Surely more unconstitutional laws are on the way from these parasites!

We`ve allowed this for 250yrs. Just`Us, Rinse & Repeat.

I can't see the 2nd circuit just rolling over and doing anything different just because 2 guys of SCOTUS wrote a letter saying come back later. Why would they? If they reverse it and rule in our favor we are given back our rights. But if they don't then MAYBE SCOTUS picks it back up and MAYBE they have enough votes to restore our rights. There were only 2 justices that got on board with the letter. Why wouldn't the 2nd circuit take their chances? It would be better than giving us what we want right now. Maybe it wouldn't happen for a year or 2 or maybe it would never happen. They'll roll the dice and we'll suffer in the meantime.

If the SCOTUS has to decide, it stands for the whole country. Maybe that is what they are waiting for.

But in the mean time, time and tax dollars are being wasted playing cat-n-mouse games back and forth.

I have no faith in no one except God and most of my immediate family members and a few friends. I have zero faith in the courts, our government, or our politicians. I stocked up and took care of myself in the Buffalo Blizzard and I’ve done what I could to prepare for this.

I agree. The second circuit will toss us a few bones and hope we don’t go to scotus or cause a delay. The longer they delay the more likely the courts make up will shift. This is the beginning of the end for us and our rights. Brien will mean nothing without enforcement and without a conservative majority on the court. The court said we got Roe V Wade wrong and the liberals when they are back in charge will say we got NYSRPA V Bruen wrong and we’re back to the two step validation process or worse. It may take 5 years, maybe 10 years but it will happen. Get ready and be ready.
