That being said, what if Trump knows that? Maybe it's a "sacrificial lamb" case. IE, make an executive order that he knows likely won't hold BUT will require litigation to hash out. You can only fight so many battles at once. If it takes up some of the other sides legal resources, that means they aren't directed at other things. I'm not sure if he's that tactically astute, but it would be a good play.
