permit to purchase does not equal permit to possess..

Further more your statements about Illinois and Massachusetts only apply to residents of those states.. Non Residents can possess a pistol without a permit in those states..

MGL C.140 § 131G is very clear about this:



"Any person who is not a resident of the commonwealth may carry a pistol or revolver in or through the commonwealth for the purpose of taking part in a pistol or revolver competition or attending any meeting or exhibition of any organized group of firearm collectors or for the purpose of hunting; provided, that such person is a resident of the United States and has a permit or license to carry firearms issued under the laws of any state, district or territory thereof which has licensing requirements which prohibit the issuance of permits or licenses to persons who have been convicted of a felony or who have been convicted of the unlawful use, possession or sale of narcotic or harmful drugs; provided, further, that in the case of a person traveling in or through the commonwealth for the purpose of hunting, he has on his person a hunting or sporting license issued by the commonwealth or by the state of his destination. my arguement was very simple.. that NY is the only state that requires a permit for possession.. without a pistol permit an adult cannot so much as handle a pistol legally (as the law is written) in the state of NY.. no other state places that kind of restriction on someone..

I dont believe FOPA applies only due to the fact that the pistol was loaded..

not that is applies in this situation because of the loaded firearm..

FOPA does not restrict your travel in such a manner that it has to start in one state and end in another..

Under FOPA, notwithstanding any state or local law, a person is entitled to transport a firearm from any place where he or she may lawfully possess and carry such firearm to any other place where he or she may lawfully possess and carry it, if the firearm is unloaded and locked out of reach. In vehicles without a trunk, the unloaded firearm must be in a locked container other than the glove compartment or console. Ammunition that is either locked out of reach in the trunk or in a locked container other than the glove compartment or console is also covered.
