Ammo background checks to begin mid-September?

They know you/us, and all too well. Jump thru the hoops to get a pistol permit, make the purchase and fill out the paperwork for a gun and or ammo and NYS and the feds have the driver license no, SS no., credit card info (if used), address, etc. With the SS number they follow you from birth. Buy guns/ammo they not just follow you, they watch you. I'm sure the state & feds swap info, or at least have access to each others info upon request on every citizen, especially gun owners. And I believe they put every gun owner on some kind of watch list.

Do they "own you"?... not literally. But you/we are becoming their bitch real quick like.

Only for hand guns I THINK. All I know is that there are a few PA gun shops right over the border here who do sell long guns to ny residents provided that they are legal to own in NY. Aka they aren't selling you a full featured ar, but will see you a Henry .357. I know because one of them purposely stocks featureless ar for that purpose. I also know because they said they would sell to me.

That doesn't mean that individual stores don't want to deal with the hassle and refuse to sell to ny residents. Your experience may be just as valid.

1. I read concerns about buying ammo out of state, and bringing it back home across state lines. Is it legal or illegal to do so?
   1. If it is legal, then tracking cars via EZ pass or any other means, stopping people, searching their trunk, and discovering ammo, is pure harassment, and of zero consequence? While I certainly object to that kind of harassment, it is NOT like fireworks, since fireworks are illegal in NYS, right?
2. Are private ammunition sales affected by this at all?
3. Also, since it is mentioned in the video in post 852, is it legal to "gift" ammo? I.e. can one give ammo for a Christmas or birthday gift?
4. What if one goes to a LGS, and brings a box of XYZ ammo to the sales counter for purchase; the clerk runs the background check, and the result is "delay". What happens to that box of XYZ ammo? Does it go back on the shelf, or does the LGS "hold" it for you? If they "hold" it, that means they will need to store and organize any "delayed" ammo? If they don't "hold" it, what happens if you come back after the "delay" clears, but XYZ ammo is now out of stock? The background check fee is paid up front. I'll guess NYS will say that's tough titties for the LGS, but curious if anyone knows the facts?

Seems very unfair to the FFL and ammo supplier, as well, of course to the buyer having his/her right denied.
5. Has anyone seen any documentable list of quantity limits, or frequency limits for ammo purchases?
6. Is writing a post like this on a public forum going to result in my being "delayed or denied"?
7. Is there a documented list of reasons for "delay or denial"?

Oh they can sell it but must ship to a NY FFL to pick up. That does not take a background check to do until you pick it up in NY. Have you witnessed a background check to a NYer who walked out the door legally?

As it is right now PA businesses can't sell a firearm to a NY resident. Don't you think Hochul and James are already working with PA officials to ban them from selling ammo to us as we speak? Look, I don't agree with the data required to purchase ammo but I do know that by me calling and emailing and doing many other things such as owning a car that government already knows all those things about me. The main objective in all this is to put law-abiding FFL's out of business all the while getting us to argue amongst ourselves.

Only thing that changed in NY was background checks for ammo, but that is in NY, not in PA. Im not required to ask for ID when someone is buying ammo unless they may be under that age of 18 or under the age of 21 when buying handgun ammo. The new background check system in NY that is being handled by the state police has nothing to do the buyer. Pennsylvania is already a point of contact state and the state police here run the background check system so NY is doing the same thing.

They need probable cause to stop and search. Just seeing ammo isn’t illegal so no reason to stop and search. Drive legally and you will be fine.

It was a Henry lever action .410. My friend goes to PA every couple of weeks and is on a first name basis with numerous FFL's. I don't know if it's a law but why would several dealers not sell him a long gun? I'm telling you what happened in actuality not some hearsay that I heard from my cousin's friend who has a friend whose uncle used to work for the state police.

It’s not PA law it’s NYS law. FFL’s can only sell guns legal to own in your home state to you. You need the semi auto endorsement to take possession of them as of now. Sucks but it’s the truth.

Actually not only if bought in NY. I believe it is written as transferring or taking possession of one after 9/4/2022 and if NYS is your state of residence you’re assumed to be taking it home with you and therefore an out of state FFL can no longer sell you one. A carve out for borrowing one has been made…. For now.

In my experience no. Pre unSafeAct it was not possible in PA. The reason is the stripped lower could be built to become a pistol. So tradition is from historic federal law.

A stripped lower is an "other". They can still be sold. It was even on the NYS site on Q&A. A lower can be be uilt into a bolt rifle, they are out there.

The laws about selling state legal firearms when making an outof state purchase are from the ATF.

Handguns, frames, receivers and firearms (e.g. Mossberg Shockwave) has to be shipped to your dealer in the state you reside in by federal law, long guns do not.

Man it’s almost like an individual could drive to PA or Ohio and buy as much bacon as they like, stop at a shipping company in that state and mail their recently purchased bacon to themselves back home, and then drive back with an empty vehicle.

if the federal government could not stop booze during prohibition, if nys government can not stop fireworks or drugs, makes one one wonder how effective the would be against stopping anything else.
