Hypothetical questions if HR 38 passes

That's what the bill says. It says that ANY issued state license is valid in Any state. It would render the NYS permit meaningless assuming you moved in from another state with your own pistols. Getting new guns would be the problem and you'd need the NY one to do that since federally you cannot buy one in another state unless you built your own.

I had not considered about the issue of only being able to purchase handguns through FFL in your state of residence.

But I imagine that some people would get fed up with NY enough to move to a nearby state, and then buy what handguns they want there. And I suppose it is also possible that some of them might find they don’t like their new home and then decide to move back to NY a month or two later.

If it passes and is signed by Trump, there are two things about it that I would really appreciate. The first would be exactly what the law is intended to fix, namely my right to travel anywhere in the USA with the ability to carry without the worry and hassle we see today.

The second thing would be the great feeling of joy knowing that the asshole anti’s could not do anything to prevent me and countless others from carrying everywhere.

Few things not mentioned in the thread so far, and why we really would want this bill passed the way that it is written.

@VietnamEraVet touched on part of the lowest standard but to add to that, this bill would also protect US here in NY to have the ability to have any handgun we want and any magazine size (for handgun) we want. As long as you have a license from a state that doesn't restrict handguns or magazine choice/size a 51oz handgun with 11+1 rounds would have to be good to go here in New York.

Assuming you are correct on the gun and magazine points, I am thinking that same thing would apply to threaded barrels on your handguns.

So, it seems as though that would take a nice chunk out of NYSAFE. So, no standard capacity mags for your AK, but running with 15+1 mags in your semi auto handgun would be perfectly legal. And it seems to me that if you brought your pistols here from another state, then as long as you did not apply for a NY CCW, then NY would not have the right to have a list of the handguns you owned either.

As for the having a handgun that isn't on a license I'm not sure how that will work here in NY.

But if this passed and You have a nonresident license from a different state ie PA (hint hint, get your PA now if you can) it would effectively null and void all of the safe act handgun assault weapon classifications. (Granted the federal stuff like a forward vertical grip NFA parts would still be a no go but for other reasons)

Ok as per safe act here is what a semi auto pistol with ability to accept a detachable magazine cannot have otherwise it is considered an "assault weapon" (one feature similar to the rifle bull shit). I have underlined the ones that HR38 would negate if passed as is, and annotated the ones that it won't help with and why

1) Folding or telescoping stock (*this alone would make it a short barrel rifle and not a pistol therefore falls under NFA)

2) Thumbhole stock (* see #1)

3) Second handgrip or protruding handgrip that can be held by non shooting hand (* would make the pistol an Any Other Weapon "AOW" thus subject to NFA and not considered a pistol, tax stamps and such)

4) Capacity to accept an ammunition magazine that attaches to the pistol outside the pistol grip

5) A threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip, or silencer (* um what also reference #3 AOW)

6) A shroud that is attached to, or partially or completely encircles the barrel and that permits the shooter to hold the firearm with the non-trigger hand without being burned

7) A manufactured weight of 50 ounces or more when the pistol is unloaded

I was going to mention that as well but I do believe it would also be covered .

Hell all the "features" for pistols that are a no go are just about 100% only for preventing ar/ak or other pistol variants of rifles, which this could help knock that out

What's fun about this is in conjunction with the ATFs ruling on shouldering a Sig brace (or the other similar products) being good 2 go it will essentially make the rifle portion of the Safe act pointless as well.

Want a AR10 with 18-22inch barrel with 30 round magazine, fuck it build an AR10 pistol with Sig brace (or similar item just going to call them all Sig brace for ease) and use a 16-24inch or what ever size barrel you want.

Nothing states that your AR/AK/FAL/BREN/ any other rifle that can also be purchased in pistol configuration pistol HAS to have a barrel under 16in. Only thing you couldn't add would be say a vertical forgrips per NFA law

***edit*** hell and if you really want to add a vertical forgrip based on a different thread I guess you can actually have AOW here in NY so you could essentially turn your pistol AR into an AOW with a 16+ inch barrel

I will try to remain optimistic, but I do not hold much hope for the Senate where rinos like John McCain , and Mitch McConnell will oppose anything that Trump campaigned on.

Ok but if someone was to say drive up from a state like Florida, that state doesn't have vehicle inspections.. do they need to get their far inspected before coming into New York?

What about our new window tint laws, do out of state drivers have to change their tint if it' legal in their state but not legal in NY.

There is no speculation if it passes the way it is currently written, the handgun, magazine, and ammunition are protected based on the carry license, so say you also have a PA nonresident license they don' have magazine restrictions. Guess what?

It would be outstanding if it passed as it is currently written. And while I do not hold much hope that it will pass the Senate, you can be sure that if it did it would not remain in its current form. Most Senators feel they are above members of Congress and are certain to change it.

Seeing that bill HR 38 regarding nationwide concealed carry reciprocity just took a step closer to becoming law earlier today, I had a few questions on how this bill would affect us here in NY. Specifically would this bill now allow us to carry our weapons into NYC? What implications would this bill have on those of us who have restrictions on our permits? Lastly, would an out of state permit (e.g. UT or PA) held by a New Yorker be recognized across the country as well?

Pl400 states that a VALID New Yorkistan CCW permit is NOT recognized in New York Shitty. NOTHING SCREAMS that the shitty should be a separate state than this. If NY Shitty wants separate CCW laws, let them become a separate state or district. Let them make their own laws and collect their own taxes.

The Senate has 100 members and for a bill to pass there it needs 51 yes votes, But here is the tricky part, the Senate can hold a filibuster forcing the need for a supermajority to pass that would mean we would need to some how get 60 yes votes for it to pass (look at how many are on board with the lesser sweet national reciprocity bill, think they can convince another 24 to vote yes on something even more pro 2a? Hell we only have what is it 51 republicans in the Senate?)

I hope to God this passes and that it survives it’s court challenges.

House Passes Concealed Carry Reciprocity Out of Committee

According to an e-mail alert from Larry Pratt of Gun Owners of America, Concealed Carry Reciprocity has passed the House committee had now heads to the floor for a vote of the full House of Representatives. That's the good news. The bad news is they also passed along an NICS Fix bill. Pratt estimates that Concealed Carry Reciprocity is a bigger deal that the NICS Fix, so overall good news.

The House is likely to pass both bills. But Concealed Carry Reciprocity is unlikely to pass in the Senate, which members of the House know. So this may be just window dressing to keep gun owners in their pocket. Time will tell.

If that worked, I'd sell all of my pistols to a relative out of state, remove all pistols from my NY permit (well, except for one...just to keep the permit active), travel to that other state where I already have a permit, and buy my pistols back. Voila...legally owned pistols that are not enumerated on any NY permit cards.
